Letter 2
-------------------------------------------------------------------------------------------------------------------------------------------------
> On 11 July 2002, IFPI
contacted you by letter informing you of the legal
rules that are
associated with the supply of copied sound files via the
Internet and
the liabilities of those who contribute to such
copyright
infringements. You were urged to cease this illegal
activity immediately to
avoid legal action against you by IFPI and/or
its Member Companies.
>
> Since we have established that the
illegal activities are still continuing
despite our request that they
cease, we are giving you herewith the final
warning.
>
> To
avoid immediate legal action being taken against you, we hereby
urge
you to cease the contribution to the illegal activities that
support the
infringement of copyright by the Website operator within
your control, and
to confirm in writing that you have done
so.
>
> The responsible service provider community has
frequently made clear its
willingness to cooperate with intellectual
property right owners to assure
that content whose illegality is called
to their attention is effectively
and swiftly blocked or taken down. As
we noted in our first letter, if you
had any questions bearing on your
ability to take action against the use of
your facilities by your
customers to infringe copyright, IFPI was prepared
to work closely and
cooperatively with you.
>
> In the absence of an appropriate
response from you, we have no alternative
but to consider legal
proceedings for the infringing conduct of both you and
the site
operator, seeking full civil damages and penalties for
wilful
infringement of copyright and, as may be appropriate, criminal
prosecution.
>
> I urge you to cease these activities and
contact me immediately.
>
> Yours sincerely
